Amend Resolution #13-1961R Dated October 17, 2013 to Re-Establish the Public Hearing Date for the Vacation of the County Right of Way Along County Route 654, Maurer Road in the City of Perth Amboy to be held December 30, 2013 at 7:00 p.m. in the Freeholders Meeting Room, County Administration Building, New Brunswick, NJ.
WHEREAS, pursuant to N.J.S.A. 27:16-28(b ), any road or portion thereof owned by any county or under the control of any county governing body may be vacated and abandoned as a public highway; and
WHEREAS, Maurer Road, a roadway designated by the County of Middlesex as CR-654 is located in the City of Perth Amboy between State Street and Amboy Avenue and measures approximately 2,640 in length and 24 feet in width, as more specifically set forth on the Schedule A; and
WHEREAS, Buckeye Perth Amboy Terminal, LLC, hereinafter "Buckeye" owns property contiguous to Maurer Road; and
WHEREAS, by Resolution adopted on August 15, 2013 (#13-1463), the County approved a Memorandum of Understanding with Buckeye for the possible closure of a portion of CR-654, known as Maurer Road, in the City of Perth Amboy and providing for the possible sale of roadway improvements to Buckeye; and
WHEREAS, the County has prepared a report identifying the reasons for and all advantages and disadvantages of vacating the public use of Maurer Road or a portion thereof and for selling the roadway improvements thereon, pursuant to N.J.S.A. 40A:12-13.5(a)(1) & (2); and
WHEREAS, on October 17, 2013, by Resolution #13-1961R, this Board declared the County's Intent to vacate County Right of Way along CR-654, Maurer Road in the City of Perth Amboy and authorized a public hearing to be held on Thursday, November 21, 2013; and
WHEREAS, publication of the public hearing was not properly advertised; and
WHEREAS, pursuant to N.J.S.A. 27:16-28(b), it is necessary to schedule a public hearing where all persons interested therein may appear and be given an opportunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Middlesex, pursuant to N.J.S.A. 27:16-28(b), this Board does hereby amend Resolution #13-1961R to re-establish the public hearing date for the vacation of the County Right of Way along County Route 654, Maurer Road in the City of Perth Amboy; and
BE IT FURTHER RESOLVED that a public hearing shall be and is hereby authorized to be held on Thursday, December 30, 2013 at 7:00 p.m. in the Freeholders Meeting Room in the County Administration Building located at 75 Bayard Street, New Brunswick, New Jersey 08901 for the Board's final consideration and action;
BE IT FURTHER RESOLVED that the Clerk of this Board shall be and is hereby directed, within three days of adoption, to cause this resolution to be advertised verbatim in a newspaper published and circulated within the limits of the County, which publication shall be inserted once in each week for three weeks consecutively before the day of the public hearing;
BE IT FURTHER RESOLVED that copies of the report prepared by the County of Middlesex shall be on file and available to the public at the Office of the Clerk of the Board of Chosen Freeholders of the County of Middlesex;
BE IT FURTHER RESOLVED that comments in writing will be included in the record of the public hearing and the record will be held open for written comments until 4:00 p.m. on December 29, 2013;
BE IT FURTHER RESOLVED that the County is hereby authorized to perform any acts necessary or desirable to facilitate the vacating of this right-of-way;
BE IT FURTHER RESOLVED that the Clerk of this Board shall forward a certified copy of this resolution to the City of Perth Amboy, the Township of Woodbridge and Buckeye Perth Amboy Terminal, LLC.
At a meeting of the Board of Chosen Freeholders on 12/5/2013, a motion was made by Blanquita B. Valenti, seconded by Charles E. Tomaro, that this Resolution by Adopted. The Motion passed. The above is a true copy, as certified by the Clerk of the Board.

Maurer Road, Perth Amboy Vacation of
County ROW Description
Maurer Road, also known as County Route 654, in the City of Perth Amboy, State of New Jersey, shall be vacated from public use from the easterly line of Amboy Avenue to the westerly line of State Street, or any portion thereof, as shown on the City of Perth Amboy approved Tax Map Sheets 81 and 82 Dated May 16, 1988. The roadway measures 2,640 feet in length and 24 feet in width. By resolution dated October 24, 1946, a certain road acquired by the County of Middlesex by petition of the City of Perth Amboy to take Maurer Road into the county highway system, filed in Road Book E 1-R-17 and Map File
