UNIVERSITY AVENUE, LAFAYETTE, LA. ATTENDANCE COUNCIL: Jared Bellard (Chair, District 5), Patrick Lewis (Vice-Chair, District 3), Kevin Naquin (District 1), Jay Castille (District 2), Kenneth Boudreaux (District 4), Bruce Conque (District 6), Nanette Cook (District 7), Liz Hebert (District 8) ABSENT: William Theriot (District 9) COUNCIL STAFF: Veronica L. Hebert (Administrative Assistant) ADMINISTRATIVE STAFF: Lorrie Toups (Chief Financial Officer), Paul Escott (City-Parish Attorney), Toby Aguillard (Police Chief), Mark Dubroc (Public Works Director), Jeffrey Stewart (Interim Utilities Director) and Danielle Breaux (Interim Development and Planning Director) (5:30:00) COMMENCEMENT AGENDA ITEM NO. 1: Call to order Chair Bellard called the Regular Council Meeting of June 4, 2019 to order. AGENDA ITEM NO. 2: Invocation and Pledge of Allegiance The Chair called upon Councilmember Cook to cite the invocation and on students from Boy Scout Troop 224 to lead the Pledge of Allegiance. WELCOME AND CHAIR ANNOUNCEMENTS Bellard made the following announcements: Item #13, (LNEDC Loan to LCG Employee) - Request by author, Jay Castille, to defer to the June 18th Council meeting as more information will be available by that meeting date from the agencies; Councilmember William Theriot is unable to attend tonight's meeting. AGENDA ITEM NO. 3: COUNCIL ANNOUNCEMENTS Boudreaux welcomed Troop 224 to the Council meeting. The students of Troop 224 announced their names and the school they attend. Boudreaux awarded each member with a LCG lapel pin. Hebert announced there will be a Town Hall meeting regarding the Robley Extension on Thursday, June 6 from 5:30 p.m. 7:30 p.m. at the South Regional Library. LCG and DOTD staff will be in attendance to answer questions. AGENDA ITEM NO. 4: EXECUTIVE/ MAYOR-PRESIDENT'S REPORT a.) Budget to Actual Comparison of Major Funds April 2019 -Toups noted that the monthly that the Budget to Actual Comparisons are to comply with statewide auditing procedures. b) Bike Safety Week Proclamation - Kathryn Reaux, Assistant to the City-Parish President, read the proclamation and presented it to Ashley Moran of the Acadiana Planning Commission. c) Love our Schools Presentation -Ryan Domengeaux, CEO of the William C. Schumacher Family Foundation explained how the Love our Schools initiative aims to help foster improved educational outcomes. On July 13th, volunteers will join together to revitalize eight (8) public schools in Lafayette Parish and will supply more than 5,000 backpacks filled with school supplies local students, in addition to other donations. CEREMONIAL PRESENTATION AGENDA ITEM NO. 5: Proclamation - National Gun Violence Awareness Day Cook proclaimed June 2, 2019, as the third annual National Gun Violence Awareness Day. Rhonda Gleason stated the statistics of gun violence and the importance of gun safety. RESOLUTIONS AGENDA ITEM NO. 6: R-035-2019 A resolution of the Lafayette City-Parish Council expressing its desire that the department of Public Works inspect or re-inspect the improvements within those subdivisions listed in Exhibit "A", attached hereto, to determine whether same should be recommended for acceptance of perpetual maintenance, motion to adopt by Naquin, seconded by Lewis, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Bellard, Conque, Cook, Hebert NAYS: None ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 7: R-036-2019 A resolution of the Lafayette City-Parish Council designating The Daily Advertiser as the Official Journal for the Lafayette City-Parish Consolidated Government for one (1) year commencing July 1, 2019, motion to adopt by Cook, seconded by Boudreaux, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Bellard, Conque, Cook, Hebert NAYS: None ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 8: R-037-2019 A resolution of the Lafayette City-Parish Council approving the renewal application (#20140823-RTA) for restoration tax abatement submitted by JD Properties of Lafayette, LLC by Frank A. Miller for participation in the State of Louisiana Restoration Tax Abatement Program (211 Garfield Street), motion to adopt by Lewis, seconded by Cook, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Conque, Cook, Hebert NAYS: Bellard ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 9: R-038-2019 A resolution of the Lafayette City-Parish Council approving the renewal application (#20140822-RTA) for restoration tax abatement submitted by JD Properties of Lafayette, LLC by Frank A. Miller for participation in the State of Louisiana Restoration Tax Abatement Program (215 Garfield Street), motion to adopt by Lewis, seconded by Cook, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Conque, Cook, Hebert NAYS: Bellard ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 10: R-039-2019 A resolution of the Lafayette City-Parish Council approving the renewal application (#20140293-RTA) for restoration tax abatement submitted by JD Properties of Lafayette, LLC by Frank A. Miller for participation in the State of Louisiana Restoration Tax Abatement Program (221 Jefferson Street), motion to adopt by Lewis, seconded by Conque, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Conque, Cook, Hebert NAYS: Bellard ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. REPORTS AND/OR DISCUSSION ITEMS AGENDA ITEM NO. 11: 2018 Comprehensive Annual Financial Report (CAFR) of Lafayette Consolidated Government by Burton Kolder with Kolder, Slaven & Company, LLC Kolder distributed copies of the audit presentation to Councilmembers and led the Council through a detailed audit summary. Toups announced that the report is available on the website. AGENDA ITEM NO. 12: Quarterly Update on the Parish General Fund Conque stated that the report that was given by Kolder, Slaven & Company, LLC was a thorough explanation and it fulfilled the update for this item. ITEM #13 WAS DEFERRED TO JUNE 18TH, PER AUTHOR'S REQUEST. AGENDA ITEM NO. 13: Update on LNEDC Loan to LCG Employee ORDINANCES FOR FINAL ADOPTION AGENDA ITEM NO. 14: O-081-2019 An ordinance of the Lafayette City-Parish Council declaring the building or structure located at 215 Thirteenth Street, Lafayette, Louisiana, owned by Lorena D. Johnson, c/o Gerald J. Block, Attorney Appointed, to be dilapidated and dangerous to the public welfare and ordering the condemnation of same, motion to adopt by Hebert, seconded by Naquin, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Bellard, Conque, Cook, Hebert NAYS: None ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 15: O-082-2019 An ordinance of the Lafayette City-Parish Council amending the FY 18/19 capital budget of the Lafayette City-Parish Consolidated Government by transferring $8,000,000 from the Library Fund Balance to the new Northeast Regional Library Construction Project and transferring $4,000,000 from Library Fund Balance to the New North Regional Library Expansion & Upgrades Project, motion to adopt by Boudreaux, seconded by Castille, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Conque, Cook, Hebert NAYS: Bellard ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 16: O-083-2019 An ordinance of the Lafayette City-Parish Council authorizing the Lafayette Mayor-President to enter into Fire Department Mutual Aid Agreements between the City of Lafayette and other municipalities, parishes, and/or volunteer fire departments, motion to adopt by Castille, seconded by Naquin,, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Bellard, Conque, Cook, Hebert NAYS: None ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. AGENDA ITEM NO. 17: O-084-2019 An ordinance of the Lafayette City-Parish Council authorizing the Lafayette Mayor-President to enter into Fire Department Automatic Aid Agreements between the City of Lafayette and other municipalities, motion to adopt by Castille, seconded by Cook, and the vote was as follows: YEAS: Naquin, Castille, Lewis, Boudreaux, Bellard, Conque, Cook, Hebert NAYS: None ABSENT: Theriot ABSTAIN: None Motion to adopt was approved. ANNOUNCEMENT OF VACANCIES ON BOARDS/COMMISSIONS AGENDA ITEM NO. 18: Due to expiration, a vacancy exists on the Alarm Review Board, for a four-year term, effective February 1, 2019. Applicants must be a minority as defined by La. R.S. 38:2233.2. AGENDA ITEM NO. 19: Due to expiration, a vacancy will exist on the Evangeline Thruway Redevelopment Team for a four-year term, effective September 1, 2019. AGENDA ITEM NO. 20: Due to expirations, four (4) vacancies will exist on the Lafayette Economic Development Authority, for four-year terms, effective September 1, 2019. Two (2) of these vacancies are required to be filled by black citizens. Individuals wishing to submit a resume for the above volunteer vacancies must be a registered voter and a resident of Lafayette Parish. Yearly ethics training for all appointees is required as is financial disclosure under certain circumstances. Resumes are to be forwarded to Veronica L. Williams, Clerk of the Council, P.O. CONSIDER APPOINTMENT BY THE COUNCIL, AS A WHOLE, TO BOARDS/COMMISSIONS AGENDA ITEM NO. 21: Appointment of Chelsi Leblanc to the Board of Zoning Adjustment, for a five-year term, effective July 1, 2019. Applicants must be a resident of the City of Lafayette and must own property within the Parish of Lafayette. APPOINTMENTS BY COUNCIL MEMBERS, MAYOR-PRESIDENT AND/OR ANY OTHER DIRECT APPOINTING AUTHORITY AGENDA ITEM NO. 22: William Theriot, District 9, appointed Bradley J. Racca to Lafayette Parish Waterworks District North for a one (1) year term effective May 10, 2019. INTRODUCTORY ORDINANCES A motion to introduce agenda items 23-31, in globo, was offered by Castille, seconded by Cook. 23.O-086-2019 An ordinance of the Lafayette City-Parish Council to authorize the Lafayette Mayor-President to enter into an amendment to the FY 18/19 cooperative endeavor agreement between the City of Lafayette, the Parish of Lafayette, and the Interim Marshal for the City Court of Lafayette. (Kenneth Boudreaux) 24. O-087-2019 An ordinance of the Lafayette City-Parish Council amending the FY 18/19 operations and maintenance budget and capital improvements budget of the Lafayette City-Parish Consolidated Government to make appropriations adjustments within the Utilities Department. (Utilities) 25. O-088-2019 An ordinance of the Lafayette City-Parish Council providing for the abandonment of a ten (10') foot utility servitude and accept the granting of a new ten (10') foot utility servitude on Lot 4 of Parc Lafayette Center, located at 1901 Kaliste Saloom Road. (Development and Planning) 26. O-089-2019 An ordinance of the Lafayette City-Parish Council authorizing the Lafayette Mayor-President to execute an amendment to the Purchase Agreement with OFCH, LLC in connection with the sale and redevelopment of property located at 705 and 731 Jefferson Street and 124 East Main Street, Lafayette, Louisiana, compromising the former Federal Courthouse building, the former public access cable station building, and the former Lafayette Police Department building. O-090-2019 An ordinance of the Lafayette City-Parish Council authorizing the filing of two (2) grant applications with the U.S. Department of Homeland Security for Assistance to Firefighters Grants for the Fire Department. O-091-2019 An ordinance of the Lafayette City-Parish Council authorizing the filing of an application with the U.S. Department of Homeland Security for a Regional Assistance to Firefighters Grant for the Fire Department. (Fire) 29. O-092-2019 An ordinance of the Lafayette City-Parish Council authorizing the Lafayette Mayor-President to enter into an agreement between the Lafayette City-Parish Consolidated Government, the State of Louisiana Department of Transportation and Development and the Acadiana Planning Commission concerning the State Project No. H.012869 LA 182 (University) @ LA 723 (Renaud) Roundabout. (Public Works) 30.O-093-2019 An ordinance of the Lafayette City-Parish Council declaring the building or structure located at 224 Paul Breaux Avenue, Lafayette, Louisiana, owned by Andrus Augustine, c/o Gerald J. Block, attorney appointed, to be dilapidated, and dangerous to the public welfare and ordering the condemnation of same. (Development and Planning) 31. O-094-2019 An ordinance of the Lafayette City-Parish Council prohibiting and making unlawful the rental or offering for rental, use, and operation of electric low-speed scooters, as defined herein, within the City and Parish of Lafayette until such time as the Lafayette City-Parish Council can promulgate rules and regulations for the safe operation of same.
